Nyce Marketing Authorization Opt-In Agreement
Introduction
This Marketing Authorization Opt-In Agreement ("Agreement") is made between Nyce LLC ("Nyce") and you, the homeowner ("Homeowner"). By agreeing to this Agreement, you consent to allow Nyce to conduct drone videography and photography of your home and solar system. In return, you will receive a luxury digital media package of the edited assets, as well as a custom referral funnel staged at https://nyce.homes to share with friends and family. Additionally, Nyce will use these assets in its own marketing materials both physical and digital.
1. Authorization
You hereby grant Nyce, its affiliates, and representatives the right to enter your property for the purpose of conducting drone videography and photography of your home and solar system.
2. Asset Usage
You authorize Nyce to use, reproduce, and publish the video and photographic assets ("Assets") captured during the drone session in any and all of Nyce's marketing materials, including but not limited to websites, social media, print materials, and advertisements. This authorization is granted on a perpetual, royalty-free basis.
3. Delivery of Digital Media Package
Nyce agrees to provide you with a luxury digital media package containing the edited Assets. This package will include high-quality video and photographic content of your property and solar system.
4. Custom Referral Funnel
Nyce will create a custom referral funnel for you, staged at https://nyce.homes. You can use this funnel to share the captured Assets with friends and family, potentially generating referrals.
5. Perpetual Usage Rights
By opting into this program, you are granting Nyce perpetual usage rights to the captured Assets for any marketing purposes without further consent or compensation.
6. No Interference
You agree not to interfere with the drone videography and photography session and to ensure that the property is in a suitable condition for such activities.
7. Liability
Nyce agrees to conduct all drone operations in compliance with applicable laws and regulations and will carry appropriate insurance coverage. Nyce is not responsible for any damage to the property unless caused by Nyce's negligence.
8. Referral Program
By opting into this Agreement, you are also opting into Nyce's referral program. You will be eligible to receive payment via the referral program if another homeowner converts through your custom referral funnel. Terms and conditions of the referral program will apply.
9. Termination
This Agreement may be terminated by either party upon written notice. However, any Assets already captured and used by Nyce will continue to be governed by this Agreement's terms.
10. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes any prior understandings or agreements, whether written or oral, regarding the subject matter herein.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of [Your State].
